I would like to become a surrogate and I was wondering if anyone knows if South Dakota allows surrogacy. I’ve looked everywhere and cant seem to find an answer to this question.

Many states have laws on the books regarding surrogacy. Some specifically make it legal, some specifically make it illegal (only a few of those) and some make it legal for traditional couples but illegal for gays and lesbians (like Florida and Texas, for example). But most states just don’t have anything at all to say about surrogacy.
To my knowledge, South Dakota is one of those states that doesn’t have much to say about surrogacy. That makes it an easy state to deliver in.
You’ll want to contact a surrogacy attorney in South Dakota to check up on the laws and verify this information. Things change constantly, and I can’t keep up with legalese in states other than my own. To find a surrogacy attorney, you may want to call a local adoption attorney and ask for recommendations. (Note: get an attorney who actually has surrogacy experience, not just adoption experience.)
